Medical malpractice takes place when a medical practitioner has been negligent in performing their duty and has affected the life of another human being. This could mean omitting a medical procedure or falling short of the standard of the medical procedure. In either of the cases, the life of the patient is endangered and if proved that the practitioner was negligent and has caused physical, mental, or emotional injury to a human being, their medical license may be cancelled. In severe cases, the medical practitioner could also be imprisoned and fined. Medical malpractice claim can be filed by the patient or any other relative of the patient who has suffered.
